COMPLAINTS AND IMPORTANT STEPS TAKEN BY CEC

CODE OF CONDUCT:

  • Code of Conduct issued;
  • ECP warned contesting candidates to fully abide by the Code of Conduct as its violation will lead to disqualification:
  • ECP has taken serious notice of news concerning violation of Code of Conduct and has taken necessary action whenever received any complaint;
  • ECP has directed all District Police Officers to submit details about alleged provision of police vehicles to ministers, etc.
  • District Returning Officers have been asked to take action against District Police Officers and SHOs if anybody in their areas is arrested on political motivation and without lawful authority.

COMPLAINT CELL:

  • ECP has set up “Complaint Cell” at its Secretariat at Islamabad to immediately deal with the complaints and that all complaints so far received about kidnapping, delimitation and transfers/postings have been disposed of;
  • Hon’ble CEC has issued directions to all District Returning Officers in the country to entertain complaints regarding elections process, hold summary inquiry and dispose of such complaints in accordance with law;
  • Hon’ble CEC has also directed to all law enforcement agencies and in particular, the Chief Secretaries and Provincial Police Offices in the country to extend full cooperation to the District Returning Officer in the disposal of complaints after holding inquiries;
  • ECP is taking action on all complaints begin received by it;

TRANSFERS MADE AFTER ELECTION SCHEDULE CANCELLED

  • Hon’ble CEC has directed cancellation of all orders of transfers/postings that have been made after announcement of Election Schedule i.e. 30-6-205;
  • Hon’ble CEC has directed cancellation of transfer orders of two Head Constables and four Constables in Badin District and Tehsildar Tangi in NWFP, which were made after announcement of Election Schedule;
  • Hon’ble CEC has directed cancellation of transfer orders of eight officials of Education Department , Tando Muhammad Khan, passed after the announcement of Election Schedule;
  • Hon’ble CEC has called upon the transferring authority to explain as to whey action should not be initiated against him for violation of provisions of sub-section (4) of section 179A of the Local Government Ordinance, 2001 as well as the directive of the Hon’ble Chief Election Commissioner.
  • Hon’ble CEC has also called upon the high officials, on whose recommendations the transfers under reference were made, to explain their position as to why action should not be taken against him in accordance with law.

CEC TOOK NOTICE OF “UNOPPOSED ELELCTION” OF NAZIM / NAIB NAZIMS OF CERTAIN AREA

  • Hon’ble CEC has taken notice of the fact that a large number of Union Nazims and Naib Union Nazims relating to a particular group have returned unopposed;
  • Hon’ble CEC, in order to ascertain the truth, has directed District Returning Officers of Tharparkar and Umerkot districts to hold a fact-finding inquiry after having reports from concerned Returning Officers.
  • Hon’ble CEC has also directed all aggrieved persons to appear before the concerned District Returning Officers immediately;

MINORITY COMMUNITIES – ALLOCATION OF ADDITIONAL SEATS ON THE BASIS OF POPULATION

  • Hon’ble CEC, on complaint, directed allocation of additional seats to minority communities in such union councils where their population was in excess of 10% of the total population;
  • AS a result, Government of Sindh has issued Notifications allocating additional seats of Minority Communities in the Union Councils of 12 Districts of Sindh Province in accord with proviso to Section 87 of Sindh Local Government Ordinance, 2001.
  • Allocation of additional seats to minority communities is apart from 1 seat reserved for minority communities in each Union Council.
  • Details of additional seats for Minority Communities with the name of concerned Union Councils have been provided to the concerned District Returning Officers and Returning Officers where additional seats for Minority Communities have been allocated.
  • The District where such seats have been allocate are: City District Karachi (Jamshed Town), Jacobabad, Tharparkar, Sanghar, Umerkot, Mirpurkhas, Badin, Jamshor, Matiari, Kandhkot, Tando Allayar, Tando Muhammad Khan.

WOMEN PARTICIPATION

IN LOCAL GOVERNMENT ELECTIONS;

  • Hon’ble CEC has ordered that elements preventing women from participating in elections will be taken to task and that such election will be declared void;
  • Hon’ble CEC with a view to facilitate women participants in elections, has provided extra time to file their nomination papers in those four districts of NWFP where instances of restraining women from casting votes have been reported.
  • Hon’ble CEC, has warned such elements not to commit such illegal acts which are offence in the eyes of law. If ECP noticed that women voters were not allowed to cast votes at the Polling stations, the elections in such Union Councils will be declared to be void.
  • The Islamic Injunctions also provide equal right of women as has been known from the Holy Quran and Sunnah and the equal right of women has been clearly quoted in the last Sermon of Holy Prophet (PBUH).
  • Recently, ECP has declared polls held in BP-12 Killa Abdullah-II to be void and ordered re-poll in the said constituency, on the grounds inter alia that women voters were not allowed to cast votes even at Poling Stations established exclusively for female voters.
  • Hon’ble CEC has reiterated his commitment to hold Local Government Elections, 2005 in a fair, free and transparent manner;
