AN APPEAL NOT DISPOSED OF WITHIN THE PERIOD SPECIFIED SHALL BE DEEMED TO HAVE BEEN REJECTED ---SECTION 14(6) OF THE REPRESENTATION OF THE PEOPLE ACT, 1976.

          Islamabad, the 1st  June, 2008.-Kanwar Muhammad Dilshad, Secretary Election Commission of Pakistan has informed that the record of the file and divergent Judgments rendered by the Members of the Appellate Tribunal, seized of the appeals arising from the acceptance of Nomination Papers of M/s Mian Muhammad Nawaz Sharif and Mian Muhammad Shahbaz Sharif, were received today in the office of the Election Commission of Pakistan for further necessary action. He further informed that the matter was thoroughly examined and the file was returned to the Registrar, Lahore High Court, Lahore with the observations of the Hon'ble Chief Election Commissioner of Pakistan that no further action can be taken in the matter in view of sub-section (6) of Section 14 of the Representation of the People Act, 1976, which is worded thus:

 
"An appeal not disposed of within the period specified in sub-section (5) shall be deemed to have been rejected."
 

2.         The Secretary Election Commission further added that according to the Election Schedule notified on 7th May, 2008 the last date for deciding appeals by the Appellate Tribunals was 31st May, 2008, which has passed.
