Ban on transfer/posting of officers/officials of the Federal/Provincial/ Local governments posted in the province of Sind

No.F.8(12)/2012-Cord(1)WHEREAS the Election Commission vide its Directive dated 02nd April 2013, directed the Federal and Provincial Caretaker Governments to:

(i)     Shuffle/transfer all Federal and Provincial Secretaries. However, if the caretaker government considers that a Federal or Provincial Secretary is independent and need not be transferred/shuffled, it may refrain from doing so and intimate the same to the Election Commission.

(ii)   Assess whether the Chairpersons / Chief Executives of all autonomous and semi-autonomous and/or state owned bodies, IG Police, CCPOs, City Commissioners, DCOs, DPOs, SHOs, patwaris and EDOs are independent individuals and transfer those who do not meet this criteria.

            AND WHEREAS a number of complaints are being received in the Commission that in the province of Sindh, postings/transfers of the officers are being made on political pressure which is undesirable because of its adverse effect on fairness and impartiality of the electoral process.  

            NOW, THEREFORE, in exercise of the powers conferred upon it under Article 218(3) of the Constitution and all other powers enabling it in that behalf, the Election Commission has re-considered the matter and has directed that there will be complete ban on transfer/posting of officers/officials of the Federal/Provincial/ Local governments posted in the province of Sindh. The Commission has further directed that in case of any exigency of service, prior approval of the Commission shall be obtained before any posting/transfer of any officer/official mentioned above is made.
