Subject: -       DISSOLUTION OF TEHSIL COUNCIL WARI DISTRICT UPPER DIR

 

            No.F.23(1)/2015-LGE-KPK(Vol-II).- WHEREAS, the Hon’ble Peshawar High Court, Mingora Bench (Dar-ul-Qaza), Swat vide its judgment dated 7.11.2016 in W. P No. 14-M/2016 in C.M No. 738/2016 (Gul Bahadar and Saeedullah vs. ECP and others) allowed W. P and has dismissed the connected W.P. 3021-P/2016 (Hussain Ahmed and Mushtaq Muhammad vs. ECP and others) and directed Election Commission of Pakistan to proceed with the 3^rd round of elections as per schedule sine scrutiny in Tehsil Council Wari district Upper Dir.

            WHEREAS, the provincial Government of KPK vide notification dated 12^th July 2016 had amended Section 79 of Khyber Pakhtunkhwa Local Government Act, 2013 deleted/ omitted provisos allowing three rounds in case of equality of votes.

            WHEREAS, the Election Commission, in pursuance of the order of the Hon’ble Court, has issued schedule for 3^rd Round of election for aforesaid council vide notification No.F23(1)/2015-LGE-KPK (Vol-II) dated 5.12.2016 and fixed 6.12.2016 (Tuesday) for the purpose.

            WHEREAS, no candidate has secured majority votes of the total membership against the seats of Nazim and Naib Nazim in 3^rd Round/ Sitting of election held on 6.12.2016.

            WHEREAS, no candidate has secured majority votes in all i.e. 1^st, 2^nd and 3^rd, Rounds/ Sittings of elections held on 30.8.2015, 13.9.2015 & 6
