ECP DIRECTIVE

DIRECTIVE

WHEREAS on 2^nd April 2013, the Commission had directed the Federal and Provincial Caretaker Governments to:

(i)     Shuffle/transfer all Federal and Provincial Secretaries. However, if the caretaker government considers that a Federal or Provincial Secretary is independent and need not be transferred/shuffled, it may refrain from doing so and intimate the same to the Election Commission.

(ii)   Assess whether the Chairpersons / Chief Executives of all autonomous and semi-autonomous and/or state owned bodies, IG Police, CCPOs, City Commissioners, DCOs, DPOs, SHOs, patwaris and EDOs are independent individuals and transfer those who do not meet this criteria.

WHEREAS it has come to the knowledge of the Commission that no transfers have been made in the Province of Sindh in pursuance of paragraph (i) of the aforementioned direction and nor has the Commission received intimation with reasons that the same is not necessary.

WHEREAS the Commission has recently received a number of complaints which allege that several officials in the administration of the Government of Sindh are partisan in favour of political parties in the previous Government. Specific complaints have been received in relation to the following individuals:

WHEREAS, it is the duty of the Commission to ensure that there is a level playing field for all contesting candidates so that free and fair elections can be held as mandated under Article 218 of the Constitution of the Islamic Republic of Pakistan. Moreover, Caretaker Governments should endeavor to ensure that they not only act as neutral, but are also seen to be neutral.

NOW THEREFORE, the Government of Sindh is directed to (i) make over-all compliance of the Commission’s directive dated 2^nd April 2013, and (ii) specifically, transfer the individuals mentioned in paragraph 3 above and replace them with officers who will inspire confidence of all stake holders on an urgent basis. Compliance of para 5 may be intimated to the Secretary of the Commission within seven days hereof.
