FAKE DEGREE HOLDERS TO BE PROSECUTED: ACTING CEC

            Islamabad, the 6th May, 2010.-     The Hon’ble Acting Chief Election Commissioner Mr. Justice Javed Iqbal has directed that the persons whose degrees have been declared fake and bogus by the courts, be prosecuted in accordance with law and action to this effect may be initiated immediately  and they may not be allowed to contest any election in future. It is pertinent to mention here that the filing of false and incorrect declarations and statements by the candidate is an offence of “Corrupt Practice” within the meaning of section 78 of the Representation of the People Act, 1976 and is triable by the District & Sessions Judge concerned in terms of Section 94(2) of the said Act.

 

2.         The Acting CEC has further directed that pending election petitions in which bachelor degree of the successful candidates is under dispute be decided, preferably, within four weeks by the learned Election Tribunals after day to day hearing of the cases.

 
3.         The dictum as laid down by the Hon’ble Supreme Court of Pakistan in cases titled “C.P.No.800/2010 (Allah Wasaya Vs. Election Tribunal for Constituency PP-259 Muzaffargarh-III Lahore and others”, “C.P.No.287/2008 (Nawabzada Iftikhar Ahmed Khan Baber Vs. Chief Election Commissioner, Islamabad and others”, C.P.No770/2010 (Nazeer Ahmed Vs. Election Tribunal, Lahore High Court, Lahore and others), being binding in nature pursuant to the provision as enumerated in Article 189 of the Constitution of Islamic Republic of Pakistan, is to be implemented.
