Meeting of the Election Commission of Pakistan was held under the Chairmanship of Mr. Justice ® Qazi Muhammad Farooq, Chief Election Commissioner at Karachi, the 15th October 2008
Karachi, the 15th October 2008 : Kanwar Muhammad Dilshad, Secretary, Election Commission of Pakistan informed that a Meeting of the Election Commission of Pakistan was held under the Chairmanship of Mr. Justice ® Qazi Muhammad Farooq, Chief Election Commissioner, which was attended by the learned Members Mr. Justice Nasim Sikandar, Judge, Lahore High Court, Mr. Justice Ahmed Khan Lashari, Judge, High Court of Balochistan, Mr. Justice Jehan Zaib Rahim, Judge, Peshawar High Court and Mr. Justice Ghulam Dastagir A. Shahani, Judge, High Court of Sindh.
2. In the Meeting, the following items came under consideration of the Election Commission :
I- Statements of Accounts Submitted by Political Parties:
i) The Statements of Accounts submitted by the following 47 Political Parties were found in conformity with the provisions of Article 13 of the Political Parties Order, 2002 and the Election Commission ordered that the same be published in the official Gazette for information of general public:

ii) Statements of Accounts submitted by the Political Parties after due date: The Election Commission condoned delay in submission of Statements of Accounts by the following Political Parties after the 29th August, 2008 and accepted the said statements for publication in the official Gazette:
1) Roshan Pakistan Party;
2) Pakistan Aman Party;
3) Pakistan Brohi Party;
4) Jamiat Ulema-e-Pakistan (Niazi);
5) National Party; and
6) Pakistan Mazdoor Kissan Party.
iii) Statement of Accounts received through UMS: The Election Commission ordered that the Statements of Accounts received through UMS from the following 3 Political Parties be returned for resubmission within 30 days through an office-bearer of the party, duly authorized by the Party Leaders, as required under rule 11 of the Political Parties Rules, 2002:
1) Pakistan Fatima Jinnah Muslim League;
2) Pakistan Awami Tehreek; and
3) Azad Pakistan Party.
iv) Un-Audited Statement of Accounts: The Election Commission ordered that un-audited Statement of Accounts submitted by “Pakistan Bachao Party”, as required under Rule 10 of the Political Parties Rules, 2002, be returned to the respective political party, for resubmission within 30 days, after getting the same duly audited by a Chartered Accountant.
v) Statements of Accounts to be returned to the Political Parties: The Election Commission ordered that the Statements of Accounts submitted by the following 3 Political Parties be returned to them for the reason that these parties had never submitted their respective party Constitutions and other related documents, as required under Articles 4 and 12 of the Political Parties Order, 2002 and the Rules framed there-under:
1) Watan Party;
2) PPP (Jehangir Badr); and
3) Qaumi Islami Party.
Kanwar Dilshad, further told that :-
II- Statements of Assets and Liabilities:
The Election Commission ordered that the Statements of Assets and Liabilities submitted by the Parliamentarians and the Members of the Provincial Assemblies in pursuance of sub-section (2) of section 25A of the Senate (Election) Act, 1975 and sub-section (2) of section 42A of the Representation of the People Act, 1976, be published in the official Gazette and the names of such Members, who have failed to file their Statements of Assets and Liabilities till date be notified and that they shall cease to function till such Statements are submitted.
III- Retention of Documents submitted by two new Political Parties under Article 4(2) of the Political Parties Order, 2002.
The documents submitted by two Political Parties, namely, Pakistan Muslim League (Sher-e-Bangal A. K. Fazal-ul-Haque) and Slam Pakistan Party were found in conformity with the provisions of the Political Parties Order, 2002 and the Rules framed there-under. The Election Commission directed that the said documents be kept on record and published in the official Gazette, as required under Article 12(3) of the Political Parties Order, 2002.
IV- Details of Intra-Party Elections of two Political Parties under Article 11(1) of the Political Parties Order, 2002.
The details of Intra-Party Elections submitted by the following two Political Parties, along with Certificate confirming thereby that the party elections have been held in accordance with the constitution of their parties as well as the Political Parties Order, 2002 were considered by the Election Commission and found to be in conformity with the provisions of said Order:
1. Pakistan Brohi Party; and
2. Pakistan Awami Tehreek-e-Inqilab.
2. The Election Commission directed that the documents of the aforesaid parties be published in the official Gazette, as required under the law.
Kanwar Muhammad Dilshad further added that:-
V- Allocation of reserved Seats for Women in the National Assembly from NWFP – Application, received from Moulana Fazal-ur-Rehman, Secretary General MMA/President JUI(F) to declare Mrs. Naeema Kishwar against the Seat Reserved for Women in the National Assembly on the quota of MMA.
Mr. Kamran Murtaza, advocate, appeared before the Election Commission in connection with the application filed by Moulana Fazal-ur-Rehman for allocation of one Seat reserved for Women in the National Assembly from NWFP to MMA. He advanced the contention that on the basis of the chart showing the position of seats obtained by each Political Party, one seat may be withdrawn from either of the two Political Parties i.e. ANP and PPPP, who, according to him had won equal number of seats in the National Assembly from NWFP and allocated to MMA. After hearing arguments of the learned counsel for the applicant, the Election Commission directed that Notices be issued to the prospective affectees of ANP and PPPP, namely, Khurshid Begum and Mrs. Farhat Begum as well as the Heads of concerned Political Parties for hearing of the case in the next Meeting of the Election Commission of Pakistan.
VI- Change/Correction of name of Mrs. Zill-e-Huma, MPA from Constituency No. PP-8 Rawalpindi-VIII
The request of Mrs. Zill-e-Huma alias Mrs. Haji Malik Umar Farooq, MPA from Constituency No. PP-8 Rawalpindi-VIII was considered by the Election Commission in the light of relevant documents available on record. In view of the position narrated in the application, the Election Commission allowed the request of the applicant and directed the office to issue necessary Corrigendum in this regard, accordingly.
VII- Complaint of Mr. Shoaib Shah Nawaz, a Contesting Candidate for Bye-Election from Constituency No. PP-107 Hafizabad-III.
After examination of the relevant record of the case relating to complaint of Mr. Shoaib Shah Nawaz, a contesting candidate for Bye-Election from Constituency No. PP-107 Hafizabad-III, the Election Commission noticed that in all 973 votes were assigned to Poling Station No. 31, whereas the margin between the winning and runner-up candidates was of 6,441 votes and that in case all the 973 votes of Polling Station No. 31 are presumed to have been polled in favour of the runner-up candidate, the result of the constituency would remain unchanged. However, the Election Commission held that since the applicant has also filed an Election Petition, which has been referred to the Election Tribunal comprising Hon’ble Mr. Justice Syed Hamid Ali Shah, Judge, Lahore High Court, Lahore, the matter may be kept pending till decision of the Election Tribunal.
