The Chief Election Commissioner has been pleased to notify that the Commission’s Notification No.F.2(4)/2008-Cord dated the 5th March, 2008, stand revived with effect from 16-7-2009

 

Islamabad, the 26^th October, 2009

 

                        No. F. 8(6)/2009-Cord.-  WHEREAS, the name of Mr. Ehsanullah Reki s/o Haji Noorullah was notified as returned candidate from National Assembly constituency No. NA-271 Kharan-cum-Washuk-cum-Panjgur (Old Kharan-cum-Panjgur) vide Notification No.F.2(4)/2008-Cord, dated the 5^th March, 2008.

 

                        AND WHEREAS, the aforesaid Notification was challenged before the Election Tribunal, Balochistn through an Election Petition bearing No. 125/2008 (Renumbered as 30/2008) filed by Lt, General ® Abdul Qadir Baloch, as losing candidate from the said constituency.

 

                        AND WHEREAS, the Election Tribunal, Balochistan vide judgment dated 16-7-2009, passed in the said Petition declared the election of Mr. Ehsanullah Reki as void and directed fresh election.

 

                        AND WHEREAS, in pursuance of the provisions of Article 224 (4) of the Constitution, the Schedule for holding Bye-election to the vacant seat from the above mentioned constituency was notified vide Notification No. F. 8(6)/2009-Cord(1), dated 16-9-2009.

 

                         AND WHEREAS, Civil Appeals bearing No. 945/2009 (Mr. Ehsanullah Reki Vs. Lt. General ® Abdul Qadir Baloch) and Civil Appeal No. 953/2009 (Lt. General ® Abdul Qadir Baloch Vs. Mr. Ehsanullah Reki), were filed in the Supreme Court of Pakistan assailing the judgment of Election Tribunal, Balochistan.

  

                        AND WHEREAS, the Hon’ble Supreme Court of Pakistan vide interim Order dated the 1^st October, 2009 passed in the said Civil Appeals, suspended the process of Bye-Election in this Constituency notified by the Election Commission of Pakistan.

 

                        AND WHEREAS, the Hon’ble Supreme Court of Pakistan finally vide Order dated the 15^th October, 2009 passed in the said Civil Appeals remanded the case to the Election Tribunal, Balochistan for fresh decision, restored the Membership of National Assembly of Mr. Ehsanullah Reki and advised the Chief Election Commissioner to issue a Notification for revival of Membership of Mr. Ehsanullah Reki.

 

                        NOW, THEREFORE,  the Chief Election Commissioner has been pleased to notify that this Commission’s Notification No.F.2(4)/2008-Cord dated the 5^th March, 2008, stand revived with effect from 16-7-2009.
